Termination

Governing Law
The use of www.waffle5.comand these Terms and Conditions shall be governed by and construed in accordancewith Malaysian law and you hereby submit to the exclusive jurisdiction of theMalaysian courts.
Order
You may follow theinstruction on ordering page to place your order. It is necessary that youprovide the requested information for us to process your order. We reserve therights to request further information from you at any time to enable us tocomplete your order and/or to comply with regulatory requirements. By placingan order, you confirm that the details contained in the order are correct inall respects. We will use various procedures to authenticate each transaction.Order details cannot be amended after the order has been placed.
A contract between you andus is formed when we receive your confirmation order and send you aconfirmation email that your order has been accepted. Please keep a copy of theconfirmation page for your records. We may, at any time, decline to processyour order or any part of your order for any reason including whereinsufficient or incorrect information has been provided.
You will be required tochoose your payment method at the time of online ordering. Payment is requiredupon placing an order. Cash on delivery is not accepted. Upon completion ofyour order, you will receive a confirmation email with order summary and aninvoice.
Cancellation
All orders can only becancelled before they are fulfilled. Upon cancellation of order, any refundwill be credited as store credit to the customer's account at waffle5.com to beused on the next purchase. Refunds to credit card or cash are not available. Norefund for cancellation once the order is fulfilled.
Goods
All illustrations anddescriptions displayed on www.waffle5.com website or distributed by email or inany other way are for guidance purposes only and will not form part of thecontract. In all cases we will try to contact you to advise you of any suchchanges, however Waffle 5 Sdn Bhd reserves the right to replace these items ofequal or better quality without consultation. We reserve the right to makealterations to the design, appearance and technical specifications of ourproducts from time to time and at such time or at any other times, to makealterations to our advertised information concerning such Goods, withoutnotice.
Allergies and SpecialDietary Requirements
Please note that all of ourwaffles may contain dairy and eggs. Some of the ingredients used may/couldcontain traces of nuts and soy products. Waffle 5 Sdn Bhd will not be heldresponsible for allergies caused from the consumption of our product.
Storage and Consumption
Our product does not containany additives or preservatives. Its air tight packaging enables them to last inan environment that is cool, dry, away from direct sunlight, up to a week.However it is strongly recommended that our waffles to be kept in the freezerfor longer shelf life (up to a month). As our waffles are product of naturalfermentation, we are therefore unable to make a warranty as to the waffles willbe having the exact same appearance for every batch. It is the responsibilityof the customer to keep the waffles in the manner prescribed by us.
Delivery Conditions
Our products are to bedelivered to you at the provided address by third-party Logistics Company. Wedo delivery within West Malaysia only. It is essential to ensure someone isavailable to receive the products at the delivery time. Customers areresponsible for paying the shipping cost for any second attempt of shipment.
Waffle 5 Sdn Bhd would notbe held liable for any missing or damaged product at the advised destinationonce the products have been delivered. It is customers’ responsibility to checkthat the order is complete in good condition upon delivery. If product is founddamage upon receiving, customer should not accept the parcel and immediatelyreturn to the courier representative. Once the products has been accepted andsigned for, Waffle 5 Sdn Bhd is unable to accept any liability neither for anydamage sustained to the products thereafter nor for any failure to follow theinstructions provided.
Force Majeure
Waffle 5 Sdn Bhd shall notbe liable for delay in performing or for failure to perform its obligations ifthe delay or failure results from any of the following: (i) Acts of God, (ii)outbreak of hostilities, riot, civil disturbance, acts of terrorism, (iii) theact of any government or authority (including refusal or revocation of anylicence or consent), (iv) fire, explosion, flood, fog or adverse weather, (v)power failure, failure of telecommunications lines, failure or breakdown ofplant, machinery or vehicles, (vi) default of suppliers, sub-contractors ordelivery partners, (vii) theft, malicious damage, strike, lock-out orindustrial action of any kind, and (viii) any cause or circumstance whatsoeverbeyond Waffle 5 reasonable control.
Complaints
We value customers’ experienceand opinion. If you experience any problem or not entirely satisfied with ourproducts, we are here to help. Any complaints must be made within [24] hoursupon receiving the products.
Returns
Customers have [7] calendardays to return an item at own cost from the date they received it. Only returnvia courier with tracking number given is accepted, walk in will strictly notbe entertained. To be eligible for a return, the item must be unused and in thesame condition that customer received it. The item must be returned in theoriginal packaging, accompanied with the receipt or proof of purchase from ourwebsite.
Refunds
We will inspect the returneditems once received and notify the customer on the status of the refund. If thereturn is approved, we will initiate a refund to the customer within 14 workingdays. All refunds will be credited as store credits to the customer's accountat waffle5.com. The store credit at Waffle 5 Account can be used for nextpurchase. Refunds to credit card or cash are not available.
Shipping
Shipping costs arenon-refundable. Customers will be responsible for paying for their own shippingcosts for returning their item. If a customer receive a refund, the cost ofreturn shipping will be deducted from the refund.
The maximum refund offeredis the value of the product. Further compensation is not available. We ask forpatience with factors that may be beyond our control (e.g. traffic conditionsetc.) as we cannot be held liable for any such delays.
Damaged item during shipment
Waffle 5 Sdn Bhd would notbe held liable for any damage that is rendered to our products at the advised destinationonce the products have been delivered. The customer is responsible to checkthat they receive the products in good conditions upon delivery. If product isfound damage upon receiving, customer should not accept the parcel andimmediately return to the courier representative. Once the products has beendelivered and signed for, Waffle 5 Sdn Bhd is unable to accept any liabilityneither for any damage sustained to the products thereafter nor for any failureto follow the instructions provided. However customer may make their own claimwith the respective courier company.
We also reserve the right,at our absolute discretion, to modify or replace these Terms at any time. byupdating this page. Please visit this page each time you enter this site asyour continued usage and access of this site after we change the terms andconditions on this page will constitute acceptance to these changes. If you donot agree to the new terms, please stop using the Service.
